ltiluestion 4 Stephen Is a junior executive earning RMtBth. He has just joined Syalikat Elargabas in September 2021 and is still under probation. While travelling to work on Friday 15',1 October, he met with an accident but luckily suffered only minor injuries. He went to a clinic to seek treatment and the doctor gave him sick leaves for Friday the 15'\" until Monday the 13th. He later informed his manager about the incident and the sick leave. A public holiday falls on Tuesday 19'\" October. So. Stephen continues to stay at home and rest. When he returned to work on Wednesday 20th. he was surprised to know that the company will be deducting three days' pay from his salary for 15'\". 18\"\" and 19"'October 2021. Stephen asks his manager about the deductions. His manager told him that two days pay is deducted for the sick leave and one day pay is when he did not show up for work on the 19". His manager reminded him that as probationer. he is not yet entitled to any sick leave until he has been conrmed. Stephen also cannot simply assume that he can take any public holiday as he wishes. Stephen protested but his manager reminded him that all these conditions were stated in his contract of service and Stephen has signed them. which shows that Stephen has agreed to be baund by the contract. Based on the scenario given above and the law under Employment Act 1955. advise Stephen on the following: 3. Whether he is entitled to get paid sick leave as a probationer and consequently whether his pay deduction is justied. {3 Marks} b. Whether he has the right to stay at home on the 19" which was a public holiday in Malaysia. [3 Marks) c. Whether he is bound by the terms in his employment contract that he has signed with the company. (3 Marks} (Total: 9 Marks)
