Lucas sold his car to Larissa for SEEHJD. Since Lucas worked at a mechanic shop [Warren's Garage}, he offered to do the required emissions 3: safety check to transfer ownership under provincial regulations at no cost as part of the sale agreement. The car passed the safety check and Larissa took ownership. Sometime after taking possession [23 weeks], Larissa noticed a minor scratch on the door handle that she had not seen before. Claiming this was a safety hazard, she attempted to return the car to Lucas for a refund. He refused, it Iwas a used car and an "as is\" sale. Larissa then brought the ear to a thirdparty mechanic who found an issue with the emergency brake that should have been detected during inspection. Larissa is suing Warren's Garage for failing to detect this problem during inspection. Warren doesn't feel he's responsible since he has never met Larissa and never had any contract with her. The cost to repair the brake would be 5500 including part: and labour. Larissa wants Warren to pay her the full purchase price ofthe car plus the cost of the additional inspection [5250} to discover the brake
