If you are unable to meet this requirement please Observe and report on the court system by visiting a court where a criminal matter or a traffic matter is being heard. If possible identify the following in a report: 1. Date and place of the hearing. 2. Name of the accused person from court list. 3. Name of the Magistrate or the Judge from court list. 4. What is the court matter about? 5. Is the accused person represented by legal counsel? If you have difficulty obtaining basic details of the court matter, the accused person, or the Magistrate/Judge, speak to the Police Prosecutor. If you still cannot get assistance, outline in your report the difficulties you experienced and include this in your observation report. Remember that courts are open to the public unless otherwise directed by the Magistrate or Judge. You do not generally need permission to sit in a court as an observer. If you do encounter problems (and this can occur), do not engage in any conflict. Rather, just do as directed and document the experience for your report. In your short report of your observations, try to include the following detail and use 'Dicey's Rule of Law' as a guide: + Could this matter have been dealt with in another way? Is the interaction between the Magistrate/Judge, the Police Prosecutor (Local Court), Crown (District Court) and the Defence Counsel appropriate in terms of their responsibilities? Did the accused person appear to understand what was happening? Did police give evidence in an appropriate and 'disinterested' manner? Using the 'The Rule of Law' definition by Dicey assess whether or not the court process could be improved. In this report you are required to demonstrate an evidence based, analytical and critical understanding of the court process. A minimum of five academic references is required.
