In order to play the video games, it is necessary to buy a gaming console and a Television both of which have a regional code. If there is a mismatch between the codes embedded in the TV and the gaming console, then video games cannot be played. However, Magic Box allowed users to access their games through over-the-top (OTT) content providers like Netflix, Amazon Prime etc. through their subscription accounts. OTTs were under strict agreement with Magic Box that they will not enable subscribers to access content beyond the country in which the subscription is sought. Magic Box had priced its video games console at a lesser price in India and eastern European countries as the purchasing power is not the same as people from countries in Western Europe. Many Persons of Indian Origin (PIO) had bought Magic Box Consoles in India providing details of their Indian address. Some of these PIOs also bought television sets which contained the regional codes for Magic Box from an importer called Desi traders who imported these TVs to London. From London, he sold these tv sets in Germany, Spain, UK, France and Belgium. Magic Box sued individual customers and Desi traders for illegally accessing its videogame in Germany, UK, France and Belgium. Desi trader filed a complaint stating that Magic Box was indulging in anti-competitive behaviour. Further, OTT content providers in Europe developed a software that prevented customers who bought OTT subscription in one EU country from accessing it in another country primarily to honour its commitment to Magic Box. However, some overzealous PIOs who lived in European countries and some citizens of EU member countries who freely moved between European countries felt that this behaviour of OTTs and Magic Box was anticompetitive.
