CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This two (2) pages Contract of Lease made and entered in to between:

JUAN DELA CRUZ, of legal age, married, Filipino and a resident of Palma, Barbaza, Antique, hereinafter called the LESSOR;

-and-

MARIA SANTOS, of legal age, married, Filipino and a resident of Igpalge, Barbaza, Antique, hereinafter called the LESSEE;

W I T N E S S T H:

WHEREAS, the LESSOR is the lawful owner of a commercial building situated at Crossing Palma, Barbaza, Antique.

WHEREAS, the LESSEE has offered to lease the commercial building standing thereat and the LESSOR agrees to lease the same to the LESSEE, subject to the following terms and conditions, to wit:

  1. TERM- This lease contract is for the period of ONE (1) year, commencing on ____________, 2021 and expiring on ____________, 2022 unless pre-terminated by the LESSEE or the LESSOR as herein below provided.
  2. That the agreed monthly rental is TWO THOUSAND PESOS ONLY (Php 2,000.00) Philippine currency per stall for a total of TWO THOUSAND PESOS ONLY (Php 2,000.00) for ONE(1) stall to be paid by the LESSEE to the LESSOR on a monthly basis, payable on or before every 16th day of the month.
  3. RENTAL DEPOSIT - That upon the execution of this contract of lease. The LESSEE further agrees to pay the LESSOR one month deposit payment.
  4. That the LESSEE is expressly prohibited to sublease the leased premises to any one, without the express consent of the LESSOR in writing.
  5. The LESSEE shall mutually keep the leased premises in good, worthy, safe and clean condition and, towards this end, the LESSOR or her authorized representative shall give the right to enter and inspect the leased premises when warranted at any reasonable hour of the day.
  6. That the LESSEE shall notify the LESSOR at least thirty (30) days in advance should the LESSEE decide to abandon the leased premises.
  7. PUBLIC UTILITIES- all expenses of water, electricity, gas and other conveniences being used to o to be used by the LESSEE in the premises shall be shouldered by the LESSEE.
  8. FORCE MAJUERE- If whole or any part of the leased premises shall be destroyed o damaged by fire, flood, lightning, typhoon, storm, riot o any other unforeseen disabling causes acts of God, substantially unfit for use and occupation of the LESSEE, then this contract may be terminated without compensation by the LESSOR or by the LESSEE by notice by writing to the other.
  9. ALTERATION- Without the written contract of the LESSO, the LESSEE shall not make any alteration, addition or improvement on the leased premises. Any improvement introduced shall be for the sole account of the LESSEE. The LESSEE, however, is allowed to remove any improvements introduced by her if no substantial damage can be caused on the premises, otherwise it shall remain thee and without obligation on the part of the LESSOR to reimburse the LESSEE for the expenses/cost in the construction thereof.
  10. REPAIRS - The LESSEE shall undertake the repair caused by ordinary wear and tear of the leased premises during the period of his occupancy, including the restoration of any damage or breakage out of the negligence of the LESSEE or members of her household thereof.
  11. The LESSEE waive her right required from Barangay up to trial court in case of default payment of the grace period within two (2) months.

  1. The LESSOR have the right to possess all contents of the premises and dispose payment of the rent.
  2. That violation of any of the above-terms and conditions will produce "ipso facto" the rescission of this contract of lease.

IN WITNESS THEREOF, the parties have hereunto set their hands on this ___________ day of _______________, 20______ at San Jose, Antique, Philippines.
