He started his collection in his teens, and now he has well over 500 hundred cards, all neatly cataloged in albums and all in very good condition. Some of the cards are in pristine condition. Because he was unable to work full time during the COVID pandemic, and because the market for Pokmon cards is very strong at the current time, Matt decided to sell some of his cards and get some ready cash. He chose about 50 of the cards that he thought would get the highest price. Although Matt followed the market for Pokmon cards generally in the newspapers and online, he was not an expert in the cards or their value. He had bought some of his collection online from Comics, Cards and Collectibles, Inc. (CCC), a store that specializes in comic books, trading cards and related collectible items. CCC is a Delaware corporation with its only place of business in Newark, NJ. Matt's past dealings with CCC had been pleasant and professional, and Matt thought that he would a fair price for the cards from CCC. Taking advantage of the incredibly low airfares between South Florida and Newark, Matt flew up to NJ one day and brought the cards to CCC's shop in Newark. Al, the owner of CCC, examined each of the cards carefully. He told Matt that, in his expert opinion, the cards were in mint condition and would have some increased value because of that, but otherwise that the cards were not especially unique. He offered Matt $1000 for the entire collection of 50 cards. Relying on Al's market experience, Matt accepted the offer, executed (along with CCC) the standard form sales contract that CCC uses (which provided, in pertinent part, that all transactions were final), received $1000 in cash from CCC (through Al) and flew home to West Palm Beach that night pleased with his sale experience. What Al did not tell Matt was that among the cards that Matt had offered for sale to Al was a mint condition 1999 Pokmon Base 1st Edition #4 Charizard card. Al had been following the accounts of a similar card expecting to sell for $500,000 in an auction in London. Al was all but dumbstruck when he saw the very same card in the lot that Matt had offered him. He secretly could not believe that Matt was not aware of the value of the card, and he knew that he would have to offer Matt a price high enough for the lot that would cause Matt to sell everything. Although he thought that the other cards were not worth more than a few dollars each, he had offered Matt the $1000 for the lot. A few days later, Matt was watching the evening news in West Palm Beach, still satisfied with himself for the sale of his cards. His satisfaction faded, though, when he watched the final human-interest story on the news broadcast. The story told of that auction in London where the 1999 Pokmon Base 1st Edition #4 Charizard card did indeed sell for $500,000. He recognized the card as one that he had sold to CCC for $1000. He was furious. The next morning, he called CCC and demanded that CCC return the card to him in exchange for his return of the $1000.
