Looi signed an agency contract to appoint Abu as her agent to sell her bungalow in

Klang. Looi instructed Abu to sell the house for not less than RM600,000.00. Abu had successfully sold the house to Mahendran at the minimum required price. Looi later found out that Abu had received a personal commission of RM5,000.00 while negotiating the contract. Looi is unhappy about this and wishes to rescind the contract with Abu.

Based on the above situation, answer the following question:

i) Explain what type of creation of agency involved in the above situation. (5 marks)

ii) Advise Looi whether she can terminate the agency contract with Abu. (20 marks)
