(a) Andrew drew a cheque in favour of Raja for RM1, 000. While writing the cheque,
he received a call from his mother, and he forgot to sign the cheque. When Raja
received the cheque from Andrew, he forged the signature of Andrew and went to
the bank to cash the cheque. The bank made the payment on the cheque to Raja.
Advise Andrew whether he could sue the bank to recover the money debited from
his account.
(b) Raju owned a car shop accessories in Kuala Lumpur. His friend, Harun, has
ordered car accessories including dash covers, seat covers, mirrors, shifter knobs,
steering wheel covers, fuel consumption meters, window tint, stereo system, DVD
players, floor mats for his new car. Raju instructed one of his employees, Chua,
to deliver all the goods ordered to Harun in Kota Bharu. Unfortunately, the lorry
broke down in Bentong on the way to Kota Bharu. Chua, then, decided to sell the
car accessories at a cheaper price to Hamid, an owner of a car shop accessories
from Raub so that he can send the lorry for repair to the nearest workshop. Raju is
very angry with Chua and asked for your advice about this matter. Advise Raju.
