Mandatory health insurance

In the Netherlands, it is compulsory to take out at least basic health insurance which covers, among other things GP care, specialist care, hospitalization, and conventional medication

Adam, a Dutch citizen, complained about the obligation to buy basic health insurance in the Netherlands and the consequences of his not having done so. The obligation is laid down in law and enforced by means of fines and the taking out of health insurance on behalf of individuals who refuse to comply with it. The main reason for the obligation is solidarity and burden sharing.

According to Dutch law, individuals with a conscientious objection to all forms of insurance may pay additional tax in lieu, but this was not Adam's case. He just expressed distrust of conventional medicine and was unwilling to contribute to that system through insurance premiums.

In 2020, Adam was fined for not having basic health insurance. His refusal to buy basic health insurance and the fine (250 euro) was challenged in national courts. Unfortunately, without success. Therefore, he considers launching a complaint at the European Court of Human Rights (ECtHR).
