MARITIME LAW 1.About 8:00 o'clock in the evening of February12, 2020, McCoy Ruby Kenneth as captain of M/V Moreno Harvey, received an S.O.S. or distress signal by blinkers, from the MV Paladar Kayelle, owned by Silorio Kent. Answering the S.O.S. call, McCoy Ruby Kenneth altered the course of his vessel which was then sailing from Dumaguete City, and headed towards the beckoning MV Paladar Kayelle. McCoy Ruby Kenneth found the MV Paladar Kayelle to be trouble due to the engine failure and the loss of her propeller, for which reason, it was drifting slowly southward from Negros Island towards Borneo in the open China Sea, at the mercy of a moderate easterly wind. About 8:25 p.m. on the same day, the M/V Moreno Harvey succeeded in getting near the MV Paladar Kayelle -in fact as near as about seven meters from the latter ship. With the consent and knowledge of the captain and/or master of the MV Paladar Kayelle, McCoy Ruby Kenneth caused MV Paladar Kayelle to be tied to, or well-secured and connected with tow lines from the M/V Moreno Harvey. The M/V Moreno Harvey had the MV Paladar Kayelle in tow and proceeded towards the directions of Dumaguete City, as evidenced by a written certificate to this effect executed by the Master, the Chief Engineer. The Chief Officer, and the Second Engineer of the MV Paladar Kayelle, who were there on board the ship at the time of the occurrence stated above.
