Six years ago, Marjorie started taking painting lessons at the Edward Thurston Willington Art Academy. Marjorie paid $4,000 per year for lessons. Lessons were given every week on Thursday night. Mr. Willington repeatedly told Marjorie that she should continue her painting lessons. He represented that her artistic ability was improving, that she had tremendous potential, and that she was becoming an excellent painter. In fact, though, Marjorie had little or no artistic ability, and her paintings were mediocre at best. Marjorie sued the Edward Thurston Willington Art Academy asking the court to declare that her contracts for lessons were voidable.
