CASE STUDIES

January 10, Jane posted her letter of acceptance. However, the post office misplaced the letter and Marky did not receive it until January 15, by this time he had sold the vehicle to Rob. Jane and Martin are indicating that they have a valid agreement with Marky and is contemplating bringing legal action against him. Marky who was so overwhelmed with all the issues facing him, decided to book into Hotel Paradise with his wife Jenny. They both signed a contract at the front desk. When they entered their room, there was a large Notice on the wall stating "Hotel Paradise will not be held responsible for any Jewellery left in the room" Marky left his expensive Rolex watch in a Dresser Drawer in the Room and went downstairs for dinner. On returning to the room, he discovered that his watch was missing. Marky reported the matter at the front desk. However, Hotel Paradise is contending that they are not liable for the missing watch based on the notice in the room excluding them for liability.
