Mary Stone was a woman 87 years old. She has no children, but has treated Dave Wagner as if he were her son for 20 years. Dave Wagner is no relation to Mary Stone. However, Dave has cared for Mary for the past 10 years. In all ways, he has cared and treated her as his mother. 4 years ago, Mary and Dave were talking as they often did. During that conversation, Dave revealed that his business had left him $45,000 in debt and the payments were "crushing" him. Mary then suggested a solution. Mary told Dave that her house was paid-off and that she had no one to give it to when she died. She had on great niece in Boston, but had not seen her since she was a child. Mary proposed to Dave that she would take out a HELOC (Home Equity Line Of Credit) on her home. She would then borrow $45,000 from the loan and give it to Dave. Dave would only have to make the minimum payments on the loan each month directly to the bank, until she died. Once she did, he could sell the house and keep the remainder. If he couldn't sell the house because the niece showed up, he could just let the home be foreclosed on by stopping the payments. She made him promise only "that you will not let me lose my home while I'm still alive." He thanked her for the generous offer. Mary went to the bank months later and secured the HELOC loan. She then gave a certified check to Dave 3 years ago. He cashed it. Dave has made 36 interest only payments on the loan. Most payments have been on-time and the loan
