Maryland rule is apparent and an attorney may not withhold the files because of unpaid fees. I like that it even specifically states the possible punishment for violating this rule. Do you think there are lawyers or firms violating this ethical rule? Violating this rule could land the attorney in trouble and may even be liable for a lawsuit from the client. I dont think it's worth it. If I am the attorney, ill cut my losses and move on.
