After searching for a few weeks, Max obtained employment as a waiter at Boudreaux's, a Cajun-style restaurant and wine bar in New Orleans' famous French Quarter, most of whose clientele consisted of under thirty, high income local male residents. Max, a very gregarious and charming person, almost always received more nightly tip income than any other waiter at the restaurant. This bothered some of his co-workers who complained to the manager and asked that all tips be pooled so that everyone would receive the same amount of tips at the end of the night. When Alexa, the restaurant manager, denied this request, two of the other male waiters began calling Max "Maxine", complained that Max constantly flirted with the male customers, mimicked the way in which he walked to the tables from the kitchen carrying his tray full of dishes and glasses, and frequently bumped into him from behind when they were taking their trays from the kitchen to their tables. On occasion, Alexa saw what they were doing to Max, but when Max would catch her eye, Alexa would just laugh and occasionally called him "Maxine". This behavior continued for several months until Max went and complained to Alexa, the person designated as the recipient of complaints under the restaurant's anti-discrimination policy. Alexa simply told Max to "man up" and just stick to his job. Max was disheartened by this response but continued to work. But after the objectionable conduct continued for another month, he eventually quit. Just before Max quit, Chloe and Jane, two female servers in the restaurant, told Max that they had overheard his prior conversation with Alexa about the conduct of the other two male waiters. They also told him that they were not surprised by Alexa's reaction to his complaints since Alexa had made many lewd and sexually suggestive remarks about their physical attributes and had repeatedly inquired into the nature and extent of these two women's sexual exploits outside of the restaurant. Just over one week after Max quit, one of these two female servers, Chloe, a sixty year old woman who had been working at Boudreaux's for nearly thirty years, met with Alexa to complain about Alexa's treatment of Chloe and her co-worker, Jane. During this conversation Chloe also told Alexa that Max had quit because of the way Alexa ignored his complaints and that she did not appreciate the way either Max or she had been treated in the restaurant by members of the staff. Three days after her conversation with Alexa, Chloe received a letter in the mail from the owner of the restaurant stating that she had been terminated for insubordination, a consistently bad attitude, because Chloe's salary was out of line
