Max Proctor (a Chinese company) entered into an Incoterm CIF contract with Fairy Beauty (a Malaysian company) for the sale of 20,000 units of concealer in different shades. On 1 June, the goods were loaded on board the ship destined for Port Klang. The bill of lading was duly issued and couriered to Fairy Beauty. Prior to shipment of the goods, Fairy Beauty had informed Max Proctor that it would like to obtain additional insurance for the goods. With the bill of lading, Fairy Beauty insured the goods and demanded reimbursement of the insurance premium from Max Proctor, on the basis that the contract included insurance. The goods arrived at Port Klang damaged. The carrier claimed that the packaging was defective (despite the clean bill of lading), while Max Proctor argued that the damage must have been caused by the carrier's negligence.
