Meizling is a dress designer. He has contracted with Carters & Carriers Inc to transport his latest creations to the 'Johnny-Come-Latelies' segment of the Fasseterre Fashion & Film Fiesta, held after the main events and established designers' presentations.
Evaluate whether either of the following contracts are void on the grounds of the doctrine of mistake in contract law.
a. Carters & Carriers Inc believes the booking for delivery to be February 23rd , the beginning of the Fasseterre Fashion & Film Fiesta and Meizling believed the booking to have been made for the February 29, the beginning of the 'Johnny-Come-Latelies' exhibitions. The contract only specifies the venue and Fasseterre Fashion & Film Fiesta;
b. Carters & Carriers Inc are involved in an accident en route and in desperation call Accidents & Aspirations Ltd to pick up and complete delivery. The rescue truck is five miles away and a price of XDX 10,000 was agreed. However, the rescue truck takes over 2 hours to arrive due to heavy traffic. In the meantime, the dresses have been put in a passing taxi and delivered at a fraction of the cost of using Accidents & Aspirations Ltd. Carters & Carriers Inc say that the contract to collect the dresses is void on the grounds of mistake as neither party would have expected such a short journey to take so long.
