Melodie works as an accountant at Myers Norris Penty LLP ("MNP") in Kelowna and has been with this firm for 10 years. When Melodie was hired there was only a confidentiality clause in her employment contract. Melodie's position with MNP grew to the point of leading the local team of 10 accountants specializing in public sector auditing (school boards, hospital boards, universities and school districts). Melodie has been approached by a representative of BDO LLP (BDO) in Kamloops to help them expand their public auditing practice in the Interior of BC. They are offering better pay and benefits. MNP says that Melodie is a fiduciary and can't seek to do public sector audit work on behalf of BDO within the Interior of BC for some reasonable time. Is MNP right? Why or why not
