Objective of this Assignment:

Through legal research, locate an Ontario Human Rights Tribunal decision related to an accommodation. Make a case summary of the decision and provide comments on other decisions involving human rights issues. Demonstrate how human rights proceedings impact employment law and highlights the link between workplace practices and policies and human rights issues.

Instructions:

Step 1: Go to the Canadian Legal Information Institute website (https://www.canlii.org/) to locate Human Rights decisions.

Step 2: Using the search field titled "Document text", search for a human rights tribunal decision involving an accommodation in the workplace. Your search criteria should look something like this: "accommodation workplace disability", "accommodation workplace religion", "discrimination in workplace" "duty to accommodate" etc.

Step 3: Locate a "Decision" of interest to you. Please do not select:

  • An "Interim Decision" or "Reconsideration Decision";
  • A decision that was dismissed because the Tribunal lacked jurisdiction (e.g. it did not have the power to decide the case because the applicant was not an employee, events took place outside Canada, etc); or,
  • A decision that was dismissed because it was filed outside the one-year statutory limitation period (e.g. applicant delayed filing the application).
  • Please contact the Facilitator if you have any questions or concerns about the decision you have chosen.

Step 4: Make a thread on the appropriate discussion forum, "Human Rights Issues" for your discussion board posting. It is recommended that you do this prior to beginning the analysis so that you can "reserve" the decision of your choice.Enter the case name as the subject line (e.g. Lunar v. Canadian Real Estate Investment Trust). In order to avoid duplication of decisions, students should check the subject lines for existing threads on the "Human Rights Issues" forum to ensure that their chosen decision has not already been "reserved" for posting by another student. If someone else has selected the decision, please select a different decision. [It may happen that two students inadvertently post a summary of the same decision at exactly the same time. If the duplication is inadvertent, do not worry.]
