Ms. Homeowner should not have to pay Mr. Painter for the cost of painting her home and does not have a claim against Ms. Homeowner for breach of contract.Ms. Homeowner asked Mr. Painter to begin painting her house two weeks after they spoke and got an estimate for the job. This would be forming an 'unilateral contract' since the contract won't take place till the job has begun. Ms. Homeowner never agreed to have Mr. Painter go out and buy materials prior to the initial two weeks. Mr. Painter does not have a lawsuit because he chose on his own to work prior to the contracted date. Being he also only gave an estimate to the homeowner, it was not stated that Ms. Homeowner is obligated to pay anything. Not having all the information in writing with a signature from both parties that they understand the terms of the contract makes the agreement between the parties is very weak. Ms. Homeowner does not owe anything to Mr. Painter since getting an estimate is still grounds to shop around elsewhere.
