Michael Lee, a retail hardware dealer, placed an advertisement in the newspaper directing attention to ladders he had for sale. The headlines were: "Sensational Factory Purchase of "Safety First Ladders". Daniel Reider took the advertisement to the store and asked to see one of the ladders. Reider asked Lee if the ladder would be good for picking apples from high trees. Lee and said, "This ladder is exactly what you want". When Reider asked Lee about strength, he said. "They were tested to (200) pounds or better." When Reider then asked about the wood, Lee said: "It's very good wood." Reider thereupon purchased the ladder. The next morning, Reider who weighed almost one hundred and fifty pounds, was using the ladder to pick apples. When he stepped on about the fourth rung, the ladder broke through both rails and he fell injured to the ground. Reider brought a lawsuit against Lee.

At the trial, according to expert testimony, the cause of the ladder's breaking was a defective side rail consisting of cross-grained wood instead of normally used straight-grained wood in the side rail near the seventh rung.
