Michelle P.(Michelle) has worked for Fair Coffee Global, Inc. (the Company), as a
Procurement Assistant since 2015. Michelle's supervisor, Gina L.(Gina), is openly a
homosexual. At the beginning of this year, Gina was going on vacation. Before she left,
Michelle gave her a few books to read on her trip, one of which was Pastor Rick Warrens
The Purpose-Driven Life. She let Gina know that the books had a Christian, Biblical
worldview.
After Gina returned from vacation, they both went into Michelles office to discuss
work-related issues. Gina brought up the books and told Michelle that she was going
through the 40-days of purpose (from the book). Gina began to share with and express to
Michelle that she feels Christianity is a "narrow-minded" viewpoint. She claimed that
there are verses in the Bible that support homosexuality. Michelle disagreed. By the end
of the conversation, they agreed to disagree on this issue and hugged. Michelle felt the
discussion ended well.
The following week, Gina emailed Michelle saying that she should not talk about those
subjects at work in the future because Michelle might be seen as intolerant by other
co-workers. Michelle responded with a clarifying email stating that she agreed with Gina
and they should not have those conversations at work. She also restated that she respects
Gina and that the issue is not homosexuality but how Gina responds to Christ.
One week after the above conversation, Michelle was called by Human Resource
Director Charles M.(Charles) into Human Resource (HR) and was told that Gina
had filed a complaint against her. He informed Michelle that she had acted in violation of
the Companys Respect, Harassment, and Discrimination Policies. (Gina had submitted
to the company a written statement of her version of the conversation). In distress,
Michelle signed to verify Ginas statement without thoroughly reviewing it. Charles gave
her two options: (1) She could either be terminated that day, or (2) remain there for
another six weeks and then resign. Michelle had to choose the latter that is to stay with
the organization for six weeks subject to resignation.
When she got home that day, she read Ginas statement and discovered that it was
an inaccurate account of their discussion. After she realized this, Michelle complained to
Charles. He advised her to write her own statement so that he would attach it to Ginas.
Michelle was placed on a leave of administration for an unknown time period. She
became extremely upset and threatened to sue the company. She and Charles have tried,
but failed to negotiate a successful resolution with the other party so far. Now both parties
are willing to try negotiation once more
