The facts reveal that if a student has the minimum grade point average for admission (2.8) and is one of the three minority groups identified above, his or her chance for admission is nearly 100%. An Asian-American student who has a 2.8 grade point average applies for admission but is denied. The student sues claiming that Central Michigan's point allotment based on race is unconstitutional.
