Minor versus substantial breach

Henry House contracts with Carl Construction Co. to build a duplex for which Henry House plans to use for rental property. The construction contract provides that Carl Construction shall use a special kind of glass for the windows that is 2 and 1/4 inches in thickness. Instead of doing so, Carl Construction used another kind of glass that has the same durability but is only 2 inches thick. Henry House learns of this a becomes furious, does not want to pay the Construction company and wants to sue.
