Miss Nancy operates Wholesale Meat & Vegetable supplies store in Cross Roads. She usually gets her regular supply of meat from Mr. Brown whose wholesale outlet was located in Montego Bay. On Tuesday August 11, Miss Nancy realizing that she was running out of her stock of Meat appointed Mr. Paul to purchase 100 pounds of Meat for her in Montego Bay from Mr. Brown.

After Mr. Paul bought the100 pounds of Meat from Mr. Brown for $20,000 the new discounted price, he also decided to purchase 150 lbs. of Lettuce for $4000 because he thought the price was very reasonable. After he had made the purchases, Mr. Paul was told that the delivery truck was not working. He tried to locate another delivery truck but was unsuccessful. After realizing that it was getting late and the Meat and Lettuce had to be refrigerated, Mr. Paul made several attempts to contact Miss Nancy, but without success. He then decided to take the Meat and Lettuce to a nearby cold storage facility until the following day, when he could try again to make contact with Miss Nancy.

On Wednesday August 12, Miss Nancy on hearing the news about the cost of the cold storage for the Meat and Lettuce became adamant and refused to pay contending that Mr. Paul acted without getting instructions from her. When asked about the costs of the Meat Mr. Paul told her that he had paid $25,000 for it. Miss Nancy later found out the true cost of the Meat and has decided to bring action against Mr. Paul. She has also refused to pay for the Lettuce which he had purchased on credit.
