Mr. Buck made the 3 hour drive to the SuperLaw legal office from Midnight, Mississippi (yes, there really is a town named Midnight located in Mississippi). He has been having issues with his neighbors. Mr. Buck has 40 acres of lands, and his neighbors' property surrounds his land. However, the neighbors' land is landlocked. These neighbors are now asking Mr. Buck can they gain access via an easement, but he doesn't even know what an easement is.
Mr. Buck wants to be properly advised before thinking about being neighborly and allowing the requested easement to be created. Attorney Doe wants you to perform some legal research and help her think through the potential legal implications. How would you advise? What must be considered? (See the below pictures of the property issue). Consider both the pros and cons of Mr. Buck allowing the easement and based on your legal research advise whether or not he should or should not allow the easement and discuss why/why not. Then use your responsive posts to offer advice to your peers regarding the easement issue and/or easement issues in general and offer tips you found regarding this legal property issue when you were performing legal research on the matter.
