Mr. Burns hires a team of salespeople to aggressively sell Burns University courses to senior citizens and less-educated people. Homer knows very little about anything but is always looking for easy ways to get rich. He barely graduated from grade 6 in elementary school. A BurnsU salesperson visits Homer at home and tells him that he can become just as rich as Mr. Burns. Homer is hesitant because he does not have much money. The salesperson convinces Homer to mortgage his home so he could pay for the courses. Without reading the contract, Homer signs a contract to take 5 courses for $50,000. He does not know that similar courses are offered by the local college for $500 per course. Homer pays the full amount upfront to Burns University. Homer takes one course and is very disappointed. Due to his limited education, he cannot follow or understand much of the material. As well, the instructor is Sideshow Bob who has no experience or training in investing. Homer demands his money back. (Note: Homer did not look at the Burns University website before deciding to enroll. Therefore, the statements in Part 3 are not relevant to Homer.) Question 9 (1 point) Listen What type of contractual defect is the most applicable to Homer's situation? Misrepresentation Duress Unconscionability Invitation to treat
