Mr. K Photographer, a renowned commercial photographer having a modern studio at Dhanmondi was adjudicated by a Bankruptcy Court as bankrupt and accordingly Receiver was appointed to deal with his properties. (a) Thus, while vesting of properties to the Receiver: (i) Mr. Manna, refused to surrender a flat in Gulshan, which was purchased by him on good faith for valuable consideration from Mr. Mahmud (the Bankrupt) before Mr. Mahmud was adjudged / became a bankrupt.(ii) Mr. K (the Bankrupt) refuse to handover an expensive 'Movie Camera' (costing around Tk.2,00,000/-) from his studio saying that it is his 'tool of profession' and as such, (in law) Receiver has no right to take them.(b) After Order of Discharge releasing Mr. K Photographer from bankruptcy:(iii) Mr. K refuse to pay his arrear income-tax that remain due to taxation authority (of the Government of Bangladesh), since he was adjudged as a bankrupt.(iv) Mr. K refuse to pay an amount of Tk. 40,000/- to his wife that remain due on account of her maintenance (during his bankruptcy) period under an order passed by a court. - Discuss.
