Mr. Laing (the deceased) was born on 19th September, 1935 in Samoa. He remained in Samoa until 1958, by which time he was some 23 years old. He went to England on 1 August, 1958 (with a Samoan passport which was valid for a period of five years) with the intention to seek work. With the assistance of a friend, who was already in England, he found a job as a porter in a department store. Mr. Laing rented premises and asked Claire to join him. In June 1959 he was joined by Claire whom he had married in 1957. Claire worked as a machinist. Only one year did Mr. Laing find himself unemployed after which he obtained a job with a different company. Mr. Laing renewed his passport in London several times for a further thirty years*. They lived together, in London, as man and wife until 1980. In 1975 Mr. Laing purchased a property in London as the matrimonial home. In 1978 they moved to another property, Kings Estate, also purchased by Mr. Laing. In May 1980 the relationship between Claire and Mr. Laing had broken down. She left the property at Kings Estate, never to return. Thereafter Claire had very little contact with Mr. Laing. On January 25, 1982 Claire commenced proceedings for divorce in London. By way of answer Mr. Laing denied that he was, or ever had been, married to Claire. The marriage was registered in Samoa but up to Mr. Laings remainder of his life and his personal representative it was declared that he had never been married to Claire. The decree nisi was pronounced in 1987. At the death of Mr. Laing on 6 June 1993 the wifes application for support and decree of divorce had not been determined. In December 1980, following the breakdown in his relationship, Mr. Laing invited his niece, Vernesha Dean, to live at Kings Estate and to act as his housekeeper. Vernesha accepted that invitation. Mr. Laing retained that property until his death in on 6 June 1993. He continued to live there with Vernesha. Vernesha remains there, in the property that has been her home ever since 1980. Mr. Laing made a will in England on 10 October 1983. He appointed Vernesha Dean and Mr. Greene, an attorney, to be his executors and trustees. He gave all his real and personal property whatsoever and wheresoever to Vernesha Dean. Probate of that will was issued to the two named executors on 18 April, 1994. *Note that Samoa gained its independence in July 4, 1997 at that time they were required to choose whether to retain the British nationality which they enjoyed by virtue of the status of Samoan as a former Crown colony or to become nationals of that island. They chose to retain British nationality. On 6 November 1997, Mr. Laing obtained a new British passport in which his country of residence was described as the UK. Mr. Laing visited Mauritius for the first time since his arrival in England in 1958. He remained there for a period of four weeks, returning to London. There was no evidence that he was accompanied by Claire. The entries in his first passport show that Mr. Laing spent two periods of one week and the other of three weeks in Samoa. Later he spent a period of one day and a further period of five weeks in Samoa. Otherwise he was in London. He spent no time in Samoa after these periods. In 1972 Mr. Laing with the assistance of influential friends established in London an air tour business offering charter flights between London and Gateway Port in Samoa
