Mr. Martinez and Mrs. Martinez have been married for 22 years. three children were born of the marriage, ms. martinez is 42, attended 1 year of college prior to the marriage. Following the marriage, both parties were interested in having children, Theerfore it was decided that ms. martinez would be a stay at home mother and take care of the home and children. As a result our client did not continue with her education and she has a few skills that would provide an income sufficent to provide for her minimum reasonable needs. Further it is not anticipated enough property will be on hand at the time of the divorce to help provide for her minimum reasonable needs. Mr martinez is 44 and is employed by ABC in the same capacity for 23 years where he earns 88k a year.
Mrs. martinez wants to attend a local community college to develop the necessary skills to enter the workforce. Mrs. martinez feels she could develop the necessary skills within two years. her question is whether she is eligible to receive alimony for the two year period in which it will take her to become self supporting and able to provide for her minimum resonable needs?
for the analysis in this memorandum how does Alexander v. Alexander, 982 S.W.2d 116 (Tex. App.- Houston 1st Dist. 1998) support or reference to this for Mrs. Martinez to be eligible for spousal maintenance ?
