Mr Ndiweni held an expired permit to occupy a plot in Gaborone township. Occupation was illegal in terms of the township regulations. however he sublet the stand to Cassim on a monthly basis. Cassim paid rent faithfully and observed all the terms of the lease. Mr Ndiweni then sought to recover the plot by ejecting Cassim on the grounds of the illegality but Cassim refused.
