Mr. X an owner of a magazine engaged Mr. Y to write an Article on the Liberation War of Bangladesh which was to be published by installments in his magazine. Mr. Y, wanted to write a rich article, and requested the publisher to allow him to publish every alternative week. Mr. X allowed him with caution that he was to be paid after the full publication of the Article. In order to write the Article with proper reference, Mr. Y planned to buy the original copy of a particular book which was rare. So, he entered into a contract with the manager of the Warsy Book House, Mr. Z, who was to deliver the only copy of that book on the payment of 5000/- taka only. Accordingly, Mr. Z ordered the book from Japan which was to be delivered within 15 days via the ship M.V Banglar Maya belonging to P. But soon after the ship sets out from Japanese port, it experiences a very rough sea as it skirts the edges of a storm. 'Q', the Captain of the ship does not feel like calling the owner 'Z'. Rather, he immediately contacts his spiritual Guru and asks for help, so that the ship can safely reaches the Cox's Bazar port. He made a gift of his farmhouse in Teknaf in favour of his Guru while Guru assured him that the ship will reach safe haven in the port. Unfortunately, unknown to both 'Z' and 'P', and to the utmost disappointment of Captain 'Q', the ship M. V. Banglar Maya sank in the sea while proceeding towards Bangladesh. When the Captain 'Q' was rescued by the Naval Coastguard, and he left the hospital after treatment, he informed 'P' about the incident and also wanted to avoid the contract of gift of his farmhouse already made to his spiritual Guru. When 'Z' gets the information, he wants to claim compensation from 'P' for the breach of contract. Due to all these hurdles, Mr. Y failed to complete his article in time and unfortunately, due to unavoidable circumstances, the publication of the magazine was stopped.
