Mubarak owns a bike. Mubarak thought of selling it and told his intention to few of his friends, that he is willing to sell the same for Rs. 30,000. A friend of Mubarak, Azam became very interested in buying it. He visited Mubarak after midnight and when Mubarak come out to see him, Azam was visibly in a drunken state and was saying that he could pay as much as Rs. 3 million for the bike. Furthermore, Azam, said to Mubarak to consider the bike "sold" and not to sell it to anyone else. It was getting late and Mubarak thought it was best to agree with Azam.
Next day Mubarak's another friend, Arif came over to Mubarak's house and stated that, "you must sell the motorcycle to me or otherwise I will commit suicide." Perplexed, by the situation Mubarak couldn't doo anything but agree.
Arif, took the bike to a mechanic for necessary inspection before making payment. The Mechanic after inspecting the bike thoroughly told Arif that it was not a Honda CD 70 (as thought by Arif) but rather a local brand called "Eagle". Arif, thought this was clear deception by Mubarak and furious at this he set the bike on fire. Arif also decides not to pay Mubarak any money.
Mubarak's brother Naseem gets to know of the situation and decides to go to a used Honda bike dealer. He thinks he can make good profit by selling a Honda bike to Arif (seeing his depression). Unknown to Naseem, the Honda dealer knowingly sells him a Honda CD 60 instead of a Honda 70. During negotiations and inspection, Arif and Naseem both are satisfied that the bike is a Honda CD 70. Next day, Arif's mechanic again breaks the bad news to Arif that the bike is not a Honda CD 70 but a Honda CD 60.
Seeing Arif's desperation, the mechanic offers to him to sell his own bike which is a Honda CD 70 for Rs. 40,000 if Pakistan's team defeat England's Team at the cricket match which was to be held the next day. England wins.
Q3- Advise Mubarak, Arif and Naseem of their legal rights and obligations under contract law.
