Much has been said of late about the erosion of the trial by jury. In other words, jury trials are taking place on a less frequent basis compared to the past. Please account for why such a phenomenon may be taking place. Do you think a criminal defendant is better off in a bench trial setting (i.e. where the judge decides guilt, rather than a jury)? Articulate a position on this point and explain your reasoning. What factors might you consider before waiving your right to a jury trial if you were a criminal defendant?
