Murdock Meadows is a farm in Langley, B.C. In the fall, the farm operates a pumpkin patch and corn maze on the farm. Visitors can purchase entry and spend as much time as they like in a fenced-off part of the farm that includes the corn maze, a pumpkin patch and a small caf where warm drinks and pastries are sold. It has become a busy attraction in October with families and youth.

The corn maze is approximately 2 acres in size. It has four entry and exit points. Throughout the maze, there are scarecrows and other characters that act as landmarks but there are no directional hints. All the entry/exit points are near the main yard of the farm where the other activities are found. This area is very well lit. There are floodlights along the sides of the maze but the back of the maze, furthest from the main yard, does not have floodlights. Instead, there are outdoor Christmas lights strung through the corn.

On a Tuesday night, Jesse is visiting Murdock Meadows with some friends. It was 8 pm and dark when they arrived. It was a clear night, but it had been raining earlier in the day. The ground was muddy and slippery. At the entry to the farm, Jesse bought a ticket and noticed a sign that said, "Flashlight recommended at night." His friend has brought a flashlight, but Jesse did not have one himself. He did, however, have his phone that he could use for light. Jesse decided that he wanted a hot chocolate to drink while walking through the maze. His friends were eager to get started in the maze. Jesse told them to go ahead, and he would catch up - he was confident in his maze-solving abilities.

Jesse bought his hot chocolate and entered the maze about 4 minutes after his friends. Each entry to the maze has a sign with the following:

"The ground can be slippery and wet. Proper footwear is required. Stay within the bounds of the maze."

The sign at the entrance Jesse used was covered in mud. He noticed there was a sign but was unable to read it.

Jesse overestimated his maze-solving abilities. After 30 minutes, he had not found his friends and was going in circles. He was stuck near the back of the maze. To make matters worse, the only lights strung in the corn had become unplugged and it was almost totally dark. Jesse used his phone for light. After another 20 minutes of being frustrated and stuck at the back of the maze, his phone battery died. Jesse had enough and decided to go through the corn and walk around the outside of the maze. Unfortunately, on the other side of the corn was a ditch. Jesse slipped in the ditch and injured his knee in the fall. He was unable to walk and had to yell for help. After about another 30 minutes, a farm employee finally heard him and was able to help him to the main yard in a small utility vehicle.

Jesse was training to be a heavy-duty mechanic at the time of his injury. He had surgery on his knee six months after the fall at Murdock Meadows. Unfortunately, Jesse is still having difficulty with his knee, and he may not be able to do the work required of a heavy-duty mechanic. His doctors are not optimistic that he will be able to do the job.

Jesse is consulting a lawyer. He wonders if he can sue Murdock Meadows for his injuries and his inability to work.
