Nancy rents a home from Ted in October and signs a 12-month lease for $500/month. The lease requires that Ted, as landlord, is responsible for maintenance and upkeep of the house and must make reasonable repairs for the benefit of his tenant. On January 10, when it is very cold outside, the heat goes out and Nancy asks Ted four times over 2 weeks to get it repaired. Ted is very cheap and says he will but never does, hoping the weather will get warmer. She moves out on January 27 (the heat is still out) and quits paying and Ted is unable to get another tenant until July. He sues her for the rent she didn't pay from February to October, the balance of the lease term. What will probably happen? Oa The lease is a contract and Nancy breached it when she moved out so she owes Ted $4.500 (9 months rent) O b. Nancy was constructively evicted so she owes Ted nothing and Ted will lose Nancy owes Ted rent for February through June, but not after he got another tenant Od. Ted will lose plus he has to pay Nancy back for rent she paid for all the months she lived there
