For entertainment, Hiram was extremely lucky. He was able to book noted jazz combo The Jazziers, who had been forced to cancel their gig aboard a cruise ship in Asia. Although The Jazziers normally would command at least $50,000 a performance, Hiram was able to book them for only $10,000.

Less than 24 hours before the party too late for Hiram to obtain substitute entertainment The Jazziers manager/agent, Shifty Lazar, called Hiram with the bad news that The Jazziers cruise had been relocated to the relatively calm waters off the coast of France. So, The Jazziers would not be performing at the Mega-Low-Mania holiday party after all. Not to worry, Shifty told Hiram. Im sending one you of my other excellent acts for the same price. You and your guests will be privileged to hear the vocal and instrumental stylings of Barry The Man I. Know, who is not Barry Manilow but an incredible simulation, a true homage to the man who writes the songs that make the whole world sing. Unfortunately for Hiram, while The Jazziers were fabulously talented, famous musicians, faux-Barry was almost totally devoid of talent, and worse yet, Mega-Low-Manias leader, E. Goe, hated Barry Manilows music.

question:

Given Hirams predicament, was there any way for Mega-Low-Mania to go to Court to force The Jazziers to honor their contractual responsibility to play Mega-Low-Manias holiday party legally proper?

If so, (1) identify the general type of remedy/source of law (not the remedys specific name) that Mega-Low-Mania would have sought in Court to obtain The Jazziers performance; (2) identify the specific relief that Mega-Low-Mania would have sought in Court; (3) set forth the two standards for this relief; and (4) explain why (i.e., what Narrative Facts) would have led the Court to order this relief.

Or if not, (1) identify the general type of remedy/source of law (not the remedys specific name) that Mega-Low-Mania would have sought in Court to obtain The Jazziers performance; (2) identify the specific relief that Mega-Low-Mania would have sought in Court; (3) set forth the two standards for this relief; and (4) explain why (i.e., what Narrative Facts) would have led the Court to deny this relief.
