Nasrulwanted to surprise his wife Maria Irwani by getting her a new car on her birthday. He decided to buy her a brand-new Proton X70, which he had seen and liked at Izzy Yati Motors Bhd. To finance the purchase of the car, he entered into a hire purchase agreement with Izzy Yati Motors Bhd. Under the agreement, Izzy Yati Motors Bhd was exempted from liability relating to the merchantable quality of the car. On the day of signing the agreement, Nasrul had difficulty reading the fine print on the agreement. He was not given any time to read the document before signing it. He noticed that the interest charged was higher than the current rate but the company insisted that it was their right to do so and Nasrul was free to go elsewhere if he was not happy. Nasrul, however, signed the hire-purchase agreement as he did not want to go through the hassle of selecting another car. Before and after signing the agreement, he did not receive any documents and only three weeks later, did he receive a copy of the agreement. Unfortunately, Maria Irwani is very unhappy with the car as the brakes are giving her a lot of problems.
