Native title law in Australia began with the High Court's decision in Mabo No 2 and has been regulated and modified by the Native Title Act 1993 (Cth). With the benefit of hindsight, if you were to design a native title system from the beginning, what things might you do differently (if anything)? Explain your answer, with reference to AUSTRALIAN case law and legislation where appropriate.
