In January 2008, Gladys got a job in Germany and left. Three years later, she had not returned home, and Nduati felt she had disserted him. He married Kanini in 2011 under the African Customary law, but never paid any dowry. They bore Jackson in 2012. Mwende fell sick in February 2013 and died a month later. A week after her death, Gladys returned home, with Germany child, Victor, which she had sired with her Germany friend in 2010, while in Germany. It has been established that while she was in Germany she paid for the full upkeep of the husband and her children Nduati now alleges that their marriage was devolved when Gladys went to Germany due to desertion.

In the light of all the above facts advice Nduati and Gladys, giving reason for each fact (15 marks)
