Negligence Example--Poorly Maintained Machine

Company is aware that due to poor maintenance (but not due to any defect in the design, manufacture of, or warnings for this machine), a machine at the company has been malfunctioning, causing a sharp metal part to occasionally stick out of the machine for the last few months. Company does not fix this malfunction during this period. Eventually, employee walking by machine is injured by this sharp part protruding from the machine.
