New Jersey has recently legalized recreational marijuana and is in the process of drafting rules governing its use, including its use in the workplace. How might this impact employers' use of drug testing in the workplace. For (1) pre-employment drug testing, (2) random drug testing (drug testing where employees are selected for testing randomly to deter drug use the workplace) and (3) reasonable suspicion drug testing (where an employer has a reasonable suspicion or basis to send an employee for a drug test based upon conduct, demeanor, or an accident), discuss how this new law might impact the balance between employee privacy and the employer's need to maintain a drug free workplace. For each of these three categories, how might the answer differ in the public and private sectors?
