NFL franchise owner Dan Snyder should be used to criticism by now. For two decades, he has been on the receiving end of fan and Native American ire. After finally dropping the offensive nickname "Redskins" this summer, Snyder put to rest at least one controversy. But he still demonstrates his thin skin. He recently filed a defamation lawsuit against a website operated by Media Entertainment Arts WorldWide over an article - since removed - that repeated rumors of sexual harassment in the Washington Football organization.

That litigation is in its early phases; we're going to address a defamation case filed by Snyder much earlier.

Some years after buying the Washington franchise, Snyder sued an alternative newspaper for libel after it published a story titled "The Cranky Fan's Guide to Dan Snyder." The lawsuit singles out the following statements as defamatory - all of which had been previously published in other media:

Snyder "went all Agent Orange" and removed trees near his home that were on federally protected land; Snyder forged names during his time as telemarketer with Snyder Communications; and Snyder was forced off the board of directors of a large amusement-park chain.

Additionally, the lawsuit targeted the alternative newspaper's use of a retouched photo to accompany the article. That photo "added insult to injury," the complaint stated. It "depicted the Jewish Mr. Snyder in a blatantly anti-Semitic way, complete with horns, bushy eyebrows, and dollar signs. That is precisely the type of imagery used historically, including in Nazi Germany, to dehumanize and vilify the Jewish people and assign them a litany of libels over the last 2,000 years."

You are an attorney for the alternative paper. What arguments will you make in your motion to dismiss the case?

Remember: After identifying the issues, assert your position, cite relevant caselaw supporting that assertion, and apply that law to the facts presented above.
