Nisha is a french citizen . Four years ago she moved to Spain where she found a job as a receptionist in a hotel in Madrid. She worked 4-hour shifts 3 days a week and was paid an equivalent of the minimum wage. Three weeks ago, Nisha went to India to visit her grandparents where she met Anil. They fell in love and married. After the wedding Nisha and Anil returned to France. Nisha terminated her contract with the hotel in Spain and is currently looking for a job in Lyon. Anil Applied for a residence permit as a family member of an EU worker, but the French Ministry for Home Affairs rejected his application and informed Anil that he could not rely on EU law in Nisha's home member state.

Nisha and Anil ask your advice whether the decision of the French Ministry for Home Affairs is compatible with EU law, in particular, the case on EU citizenship and the free movement of workers.
