Noël Carnage is a prominent British Politician and self-styled 'Bad Boy of Brexit'. Since the UK's exit from the European Union, he has made a living as a commentator on European affairs all around Europe, and as an agent provocateur for campaigns in other countries concerned with exit from the EU. He also holds dual British-French nationality, as do the two children from his first marriage. His current wife Catherine only holds British citizenship.

Noël has brought a case in the regional court of West Macedonia, which is a region of Greece, and from which cases can be appealed to the Supreme Court of Greece. The facts are as follows:

 

Noël travelled to Greece 3 months ago with Catherine and his two children, where they have been staying ever since. Noël has been making paid appearances as a freelance political commentator on Greek television regarding EU affairs. At the end of 3 months, the Greek authorities informed Noël and his family that they had no right to reside in Greece and must leave the country immediately.

 

When Noël brought his case in court, the Greek authorities argued that they had a right to deport Noël on the grounds that it was necessary in the interests of Public Policy, as he had also been attending meetings and rallies, encouraging protesters by making speeches about 'Grexit' (a campaign to encourage Greece to leave the EU). They produced evidence of his similar involvement in anti-EU movements in other EU states.

 

The matter has been referred to the Court of Justice of the EU under Article 267 TFEU, as Noël has convinced the regional court that it cannot rule on this case without the CJEU providing interpretation on the meaning of 'Public Policy'.

 

As Advocate General of the CJEU, you are required to deliver an Opinion on the following grounds:

 

  1. Advise on the rights of Free Movement that Noël and the family members living with him in Greece have, including whether the Greek authorities have the right to deport Noël for the reasons stated.
  2. Advise the Court whether the reference made by the regional court under Article 267 TFEU is valid, and whether the CJEU have an obligation to provide the interpretation that is requested.
