Later, when Brian tries to collect from Chel, he finds out that Chel is insolvent. It was proved that at the time of delegacion, Chel was already insolvent but this was not known to Andre. Neither was the insolvency of public knowledge. Brian files a cause of action against Andre on the ground that it was Andre who made the proposal, and for this reason, Andre guaranteed Chel's insolvency. Is Andre liable? Decide with reasons.

2. Andre leased his condo unit in favor of Brian. Brian subleased the property to Chel.
