Face-to-Face Bargaining Simulation
Part 1: Collective Agreement Analysis (10%)
Purpose:
The Bargaining Negotiation Simulation Activity (30% in total) is a major component of this course. It is your opportunity to participate in a labour contract negotiation simulation, putting theory into practice!
Part 1 Instructions:
Appendix C from our textbook provides a collective agreement for Clean Right Partners Inc. that will be used as the basis for this bargaining simulation.
For Part 1: Collective Agreement Analysis, you are required to INDIVIDUALLY analyze the current Clean Right Partners Inc. collective agreement and identify areas where the union and the employer would like to see changes and additions to the collective agreement. You are welcome to discuss ideas and do brainstorming with your classmates. However, each student must individually complete this assignment as it will help you prepare to contribute to your bargaining team for Parts 2 and 3 of the Face-to-Face Bargaining Simulation!
You will earn 1 point for each article successfully identified AND you will earn an additional 5 points for listing your articles in the numerical order they appear in the collective agreement with NEW articles at the very end of your submission (this assignment is out of 20 marks in total). Please use the template provided below. Please note that there are two sections to Part 1: Analyze Current Collective Agreement: (1) changes to current contract terms AND (2) new contract terms!

Instructions: Review the Clean Right Partners Inc. collective agreement and the background information provided in our textbook. Assume that you are preparing to negotiate a renewal of the agreement and complete the following:
Part 1 - Changes to current contract terms
Identify 8 articles that you think that the union would like to have changed AND 5 articles that management would like to have changed. DO NOT refer to compensation. For any article referred to, identify the existing provision, and briefly explain the changes the union might want and/or the changes management might want. For example, a union might want the number of days to file a grievance to be increased, and management may want the number of days to be decreased.
Discuss the items in the order they are referred to in the current collective agreement. There may be articles that neither the union nor management has any concerns with. There may articles that only one side has concerns with. That is okay! Choose articles that you think are important.
Refer to any changes in plain English; not contract language. Refer to only one item for each main heading/article in the agreement for each side. For example, if you indicate that the union wants a change to Article 10.2 do not add that the union also wants a change to Article 10.4. In this example, it would be permissible to indicate that management would like a change to Article 10.4, but that would be the only management change for Article 10.
HINT: Choose the articles and the changes that you think are the most significant/important. This will help you with the next phases of the bargaining simulation!
Part 2 - New contract terms
1. Identify one new provision that the union would like to see added to the contract. This refers to an issue or item that the current contract does not refer to. Explain in plain English the details of what the union would want added to the agreement and why.
2. Identify one new provision that the employer would like to see added to the contract. This refers to an issue or item that the current contract does not refer to. Explain in plain English the details of what management would want added to the agreement and why.
IMPORTANT: in total, you should have a list of 15 items you are submitting:
- 13 articles/provisions with changes to the existing language as follows:
- 8 articles/provisions that you think the Union would like to have changed
- 5 articles/provisions that you think the Employer would like to have changed
- 2 new articles/provisions with NEW language to be added to the collective agreement:
- 1 article/provision you think the Union would like to see added
- 1 article/provision you think the Employer would like to see added
- NOTE: remember that your articles/provisions should be listed in the numerical order they appear in the collective agreement with your new articles at the very end! You will earn an additional five (5) points for listing your articles/provisions in the correct numerical order. Presenting proposed changes in a logical and easy to follow way is an important part of clear communication during bargaining, which is why it is possible to earn those additional five (5) points for listing your articles/provisions in the correct numerical order. If your articles/provisions are not listed in the same numerical order as they appear in the collective agreement, you will not receive those additional five (5) points, meaning that the most you will be able to earn on this assignment will be 15/20 (remember, this assignment is out of 20 marks in total).
