Mother's Will

Mother: Dorothy Johnson (DJ), died 2 weeks ago.

Executor: Lewis Everard (LE) (DJ's brother).

DJ's will - entire estate divided equally between JJ's 2 brothers: Eric and Frank.

Background

JJ and DJ had a good relationship until JJ started a relationship with a colleague (Zak Smith (ZS)) approximately 8 years ago.

JJ and ZS became civil partners 6 years ago. Relationship ongoing and they have recently adopted a little girl, Rosie, now age 4 years.

DJ refused to recognise JJ's gender orientation and relationship with ZS. Until her death, DJ refused to meet ZS or Rosie. Very little to no communication with JJ.

Issues

JJ is very upset to be 'written out' of DJ's will. He had not expected this, even though he knew of his mother's feelings about his relationship with ZS.

JJ and ZS have limited income as they both work part-time. This work pattern was suggested by the local authority when they adopted Rosie. Their annual income is barely enough to cover their mortgage payments and other bills.

DJ's estate is worth over 5,000,000 due to the sale of a very large house in London and the sale of a business owned by DJ and her late husband.

Can JJ challenge DJ's will? He knows that Eric and Frank feel bad for him and were horrified to discover that their mother had changed her will before she died to exclude JJ.

What is the procedure for challenging DL's will if JJ goes ahead? JJ really doesn't understand LE's role - is he 'on DJ's side'? - and what happens now that his mother has died.
