Nowadays, people try to find many remedies for their illnesses. Amongst others are influenza and smoking habits. Mr.Ghoniey who a vaper had stopped smoking cigarettes but turn to like an e-cigarette at the same time infected with influenza try to find the cure for his sickness. An advert was placed for 'Anti-Influenza & Anti-Smoke Capsule' to prevent influenza and smoking habit. The advert offered to pay RM100,000 if anyone still contracted influenza and smoking habit after using the capsule. The company deposited RM1,000,000 with the CIMBC Bank to show their sincerity in the matter. The plaintiff bought one of the capsules but still contracted with influenza and smoking any cigarette.
Therefore, as a student who well verse in the law of contract, advise Mr.Ghoniey on the following issues:
(i). Whether the deposit of money showed by the manufacturer of the capsules in the CIMBC Bank shows an intention to be bound in the contract, therefore the advert was an offer?;
(ii). Is it possible to make an offer to the world at large, which is accepted by anyone who buys a capsules is true in law?;
(iii). How long the offer will protect the acceptor in his claim to defend his right?; and
(iv). Whether the buying only and not using of the capsule as purchased amounted to acceptance, therefore a contract binding upon them?
