O, a farmer, purchased Apple-acre, a 30-acre farm in the western part of New York, and constructed a house in which he still lives on the southerly half of the property. A state highway runs east and west along the northern boundary of Apple-acre. In order to travel between O's house, which is near the southern boundary of Apple-acre, and the state highway, O constructed a private paved road that runs south from the state highway across APPLE-acre to O's house. 10 years ago, O sold the northern half of his property to B. He has continued to use the private paved road to reach the state highway for those 10 years. A private dirt road along the southern boundary of Apple-acre also provides access to a county highway that runs north and south along the eastern boundary of Apple-acre. O rarely uses the private dirt road because it is in poor condition and is a less convenient route from O's house to almost all destinations. B has commenced construction of a fence along the southern border of his property and has advised O that he will no longer permit O to use the private paved road across B's property. Does O have an easement across B's Property?
